Welcome to the Rolemint website, project of Worktika Inc.!

These Terms and Conditions (“Terms”) contain important information about your legal rights, remedies, and obligations. These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Worktika, Inc. (“Company,” “we,” “us,” or “our”) governing your access to and use of the Rolemint website, applications (collectively, the “Platform”), and any related services (collectively, the “Services”). The term “Terms” includes all documents and policies linked within this agreement.

By accessing or using the Platform or Services, or by clicking “ACCEPT” when prompted, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any policies or agreements incorporated by reference.

If you do not agree to these Terms, you must not access or use the Platform or Services.

If you are residing in the European Union, nothing in these Terms deprives you of mandatory consumer protections afforded under the laws of your country of residence.

1. User

1.1. For the purposes of these Terms the USER shall be at least 18 years old.

1.2. You are responsible for all activities that occur under your account, including any actions taken by you or by anyone who accesses the Platform using your login credentials.

1.3. By using and clicking “ACCEPT” as defined herein You agree to:

• Notify us immediately at rolemint-security@worktika.com if you become aware of or suspect of any unauthorized access to your account, any unauthorized use of your password; or any other breach of security involving the Platform;
• Immediately report any unauthorized copying, scraping, distribution, or misuse of content, AI-generated outputs, employer data, or other materials available through the Platform, of which you become aware, and take reasonable steps to help prevent or stop such conduct
• Ensure that your use of the Platform, including any CV uploads, profile information, AI interactions, or communications with employers, complies at all times with these Terms and all applicable laws.

2. User Accounts

2.1. To be able to use the Platform you may be required to register or to create an account to have full access to the Platform and use all of its features promptly.

2.2. To use our Services, you’ll need to create an account and complete a user profile (“Profile”). Your Profile may be visible to other users, and depending on your privacy settings, certain information may also be publicly available.

2.3. Please make sure the information you provide is accurate, complete, and up to date. This applies to your Profile and to any forms or information you submit while using our Services. If something changes, we ask that you update your information promptly.

2.4. We rely on the information you provide to operate the Platform effectively. For that reason, you agree not to submit false or misleading information about your identity, location, business, beneficial owner(s), qualifications, skills, or the services you offer. If any information becomes inaccurate or misleading, we reserve the right to suspend your User account and any access to it.

2.5. If we determine that an account contains false, incomplete, or misleading information, we, at our sole discretion, may suspend or restrict access to the Platform and (or) the Services until the issue is resolved.

2.6. You are also responsible for maintaining the confidentiality of your password and for restricting access to your account. Any loss, damage, unauthorized access, or misuse arising from your failure to safeguard your credentials is your responsibility.

2.7. You are encouraged to use strong passwords, keep login credentials confidential, avoid sharing sensitive information through unsecured channels.

3. Representations and Warranties

3.1. By using and clicking “ACCEPT” as defined herein, you represent and warrant that:

• You have legal capacity to enter into a legally binding agreement with the Company.
• All information you provide is accurate and complete
• You own or have the right to upload your content
• Your content does not violate any law or third-party rights
• You will not upload false, misleading, or fraudulent information
• You will not upload unlawful or harmful content
• You will not use the Platform for discriminatory or unlawful hiring practices (applicable to employer users)
• You will not interfere with Platform security

4. Permissions

4.1. By using and registering on the Platform, you grant the Company a non-exclusive, worldwide, royalty-free license to:

• Host, process, analyze, and display the data provided by you as a User
• Generate insights and matching results
• Use anonymized or aggregated data to improve the Platform and AI systems

5. Privacy Policy

5.1. Your use of the Platform is subject to our Privacy Policy, incorporated herein by reference (Rolemint platform), we encourage you to get acquainted with our Privacy Policy for the best protection of your legal interests.

6. Reservations

6.1. We reserve the right to suspend or terminate or restrict access to any account that is compromised, used in violation of these Terms, or poses a security risk to the Platform or other users.

7. Fees

7.1. The Platform is currently offered free of charge, however, please note, that the Company reserves the right to introduce paid features in the future upon notice. Users will be notified in advance if any part of the Platform becomes subject to fees.

8. Intellectual Property Rights

8.1. Ownership. The Platform and all associated software, technology, content, and intellectual property, including but not limited to code, algorithms, user interfaces, designs, trademarks, trade secrets, and documentation (collectively, the “Platform Software”), are and shall remain the exclusive property of the Platform or its licensors. Nothing in this Agreement shall be construed as transferring any ownership rights in the Platform Software to User.

8.2. License to Use. Subject to User’s compliance with the terms of this Agreement, the Platform grants the User a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform Software solely for User’s internal operations in connection with the Services.

8.3. Restrictions. User shall not, directly or indirectly:

1. Attempt to gain unauthorized access,
2. Collect information that belongs to other users or to the Company,
3. Try to use Platform in unintended or harmful way.

8.4. Feedback. Any suggestions, feedback, or recommendations provided by User relating to the Platform Software (“Feedback”) shall be deemed non-confidential, and the Platform shall be free to use such Feedback without restriction, including for product development, marketing, and other commercial purposes, without any obligation or compensation to User.

9. Disclaimers

9.1. Platform Availability & Disclaimers

• The Platform is provided “as is” and “as available”. We do our best to make it reliable, but we can’t guarantee it will always meet your expectations or be free of issues.
• The Platform does not hire Users, make job recommendations, or guarantee employment or placement. Any use of the Platform for job-related purposes is at your own risk.

9.2. We make no warranties that the Platform is fit for a particular purpose, free from errors or interruptions, free from third-party intellectual property issues.

9.3. We make no warranties and are not responsible for the accuracy or bias of AI results (e.g., matching or feedback)

9.4. We may perform scheduled or emergency maintenance on the Platform or Services. Where reasonably practicable, we will provide advance notice of scheduled maintenance.

10. Third-Party Services and External Links

10.1. The Platform may contain links to third-party websites, tools, employer portals, payment processors, or other external services that are not owned or controlled by us.

10.2. If you choose to access any third-party website or service, including an employer’s website or an external payment provider, you do so at your own discretion and risk. Once you leave the Platform, we have no control over and are not responsible for the content, privacy practices, security measures, or terms of use of those third-party services. Such services are governed by their own policies and agreements, not by this Privacy Policy or our Terms.

10.3. We encourage you to review the privacy policies and terms of any third-party service before providing personal information or engaging in transactions.

11. Limitation of Liability

11.1. To the fullest extent permitted by law, the Company shall not be liable for indirect, incidental, consequential, or punitive damages, lost profits or lost employment opportunities, employer misconduct or discrimination.

11.2. Total liability shall not exceed $100 or the amount you paid to the Company in the preceding 12 months, whichever is greater. This limitation does not apply to liability arising from gross negligence, willful misconduct, fraud, death or personal injury, violations of applicable data protection laws, any liability that cannot be limited under applicable law.

12. Indemnification

12.1. You agree to indemnify and hold harmless the Company from claims arising out of your User content, violation of these Terms and your misuse of the Platform.

13. Termination

13.1. You may stop using the Platform at any time.

13.2. The Company may suspend or terminate access for breach of these Terms, legal compliance reasons, operational necessity.

14. Governing Law and Dispute Resolution

14.1. Governing Law: These Terms and any dispute, claim, or controversy arising out of or relating to the Platform and (or) the Services shall be governed by and construed in accordance with the laws of the State of California and the laws of the United States, without regard to conflict of laws principles that would result in the application of the laws of another jurisdiction.

If you are residing in the European Union, you may also bring proceedings in your country of residence and benefit from mandatory consumer protections under local law.

14.2. Informal resolution: Before initiating any formal legal proceeding, you agree to first send us a registered letter describing the dispute at the following address:

Both you and the Company agree to make a good-faith effort to resolve the dispute informally within thirty (30) days after receipt of the notice.

14.3. Arbitration: If a dispute cannot be resolved informally, any dispute, claim, or controversy arising out of or relating to these Terms, the Platform or any related Services shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect. Arbitration is a private process where a neutral arbitrator makes a decision. It is generally faster and less formal than a lawsuit. The arbitration shall be in English. Unless the arbitrator determines otherwise, it should be an in-person hearing. The place of arbitration is Los Angeles County, California, unless otherwise required by applicable consumer protection law. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, enforceability, or formation of this arbitration provision. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

14.4. Right to Opt Out: You may opt out of this arbitration agreement by sending written notice to rolemint-arbitration@worktika.com within thirty (30) days of first accepting these Terms. If you opt out neither you nor the Company may require the other to participate in arbitration. Any disputes shall be resolved exclusively in the state or federal courts located in Los Angeles County, California. You and the Company irrevocably submit to the exclusive jurisdiction of such courts and waive any objection based on inconvenient forum.

15. Modifications

15.1. We may update these Terms from time to time. Updated Terms will be posted on the Platform, and where appropriate we may notify you. Your continued use of the Platform after the updated Terms become effective constitutes acceptance of the revised Terms.
